Polygraph Information

As an offender, as someone who is on Parole, Probation, or Lifetime Supervision, you need to know your rights when it comes to the Polygraph exam.  Do not give up your rights!!!!

Please read all of the information that we present to you thoroughly, and email us with questions.  If we can explain something or help you, we will. Please read the Statutes closely, and pay attention to anything in red. They are not legally allowed to ask certain questions, unless you let them.

DO NOT ANSWER ANY QUESTIONS THAT THE DIVISION AND THE POLYGRAPHER ARE NOT LEGALLY ALLOWED TO ASK.

DO NOT LET THEM BADGER YOU AND INTIMIDATE YOU.
THIS IS YOUR LEGAL RIGHT PER THE LAW.Do not admit to anything during the test, and do not let them intimidate or scare you into admitting anything.  They cannot violate you for refusing to answer a question, or for having an inconclusive or deceptive test.

The Department of Public Safety and the Division of Parole and Probation do not perform these polygraph examinations in accordance with the laws of the State of Nevada or with your civil rights in mind.  This is strictly an attempt to get you to admit to a crime, or any violation of your conditions.

Our organization will be spending some time attempting to get this condition banished for everyone on Parole, Probation and Lifetime Supervision, as we believe it is unconstitutional to perform this test in the manner that they do.

Here is the Policy and Procedure on the Polygraph, including the NRS Statutes relating to the Polygraph, and a website with a lot of information on the Polygraph.

Supreme Court Opinions relating to the Polygraph:

Please check back often as we are updating information on almost every page weekly as we get items scanned in and uploaded.  We will be posting more Supreme Court decisions soon, and also providing a list of books that you can read on the polygraph, and check out at the local libraries in Reno/Sparks or read there.
